Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Buck The Critics mobile application (the "Service") operated by Alexander Cretney Limited ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Accounts and Registration

When you create an account with us, you must provide information that is accurate enough to maintain the account security. However, we do not require real names or strict identity verification.

1.1 One Account Per Person

To ensure fairness in our referral programs and promotional offers, you agree to create and maintain only one account per person. Creating multiple accounts to simulate referrals, manipulate reviews, or abuse free trial periods is strictly prohibited. We reserve the right to immediately terminate all accounts associated with a user found violating this rule.

1.2 Account Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. User Generated Content and Conduct

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

You expressly agree NOT to post Content that:

We reserve the right, but do not assume the obligation, to investigate and remove any Content that violates these Terms or is otherwise objectionable. Users found repeatedly violating these rules will have their accounts terminated and access to the Service revoked.

3. Content Rights & License

You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights. However, by posting Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, perform, display, and distribute such Content on and through the Service and our marketing materials.

4. Premium Subscriptions & Purchases

Some parts of the Service are billed on a subscription basis ("Premium Subscription"). The Premium Subscription provides access to advanced features including the ability to comment and participate in threads, and use the integrated AI tools.

4.1 Billing

Subscriptions are managed and billed through the platform you downloaded the app from (e.g., Apple App Store or Google Play Store) and are handled by our third-party provider, RevenueCat. You will be charged on a recurring and periodic basis (such as monthly or annually), depending on the type of subscription plan you select.

4.2 Cancellations

You may cancel your subscription renewal either through your online account management page or by contacting the App Store/Google Play support. You will not receive a refund for the fees you already paid for your current subscription period and you will be able to access the Service until the end of your current subscription period.

4.3 Right of Withdrawal (UK/EEA Users)

If you are a consumer in the UK or EEA, you normally have a statutory right to cancel a digital service contract within 14 days. However, by purchasing a Premium Subscription, you expressly request immediate performance of the contract and acknowledge that you lose your right of withdrawal once the digital service has begun. This means that once you have accessed the Premium features, you cannot claim a refund under the 14-day cooling-off regulations.

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Alexander Cretney Limited and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries.

7. Limitation of Liability

In no event shall Alexander Cretney Limited, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
